Welcome to the website of Mermaid Homes Co., Ltd. (“Mermaid Homes”, “we”, “us”, or “our”). These Terms of Use (“Terms”) govern your access to and use of mermaidhomes.co and any sub-domains, tools, chat, or services that link to these Terms (collectively, the “Site”).
By accessing or using the Site, you agree to these Terms and to our Privacy Policy (PDPA-aligned). If you do not agree, do not use the Site.

1) About Mermaid Homes & Scope of Services

  • Mermaid Homes is a Phuket-based, boutique real-estate agency. Information on the Site is provided for general information and marketing purposes only.

  • No agency or brokerage relationship is created by your use of the Site. Any representation, brokerage, or management services will be provided only under a separately executed written agreement.

  • Pricing statements such as “owner’s price” describe our commercial approach. Actual transaction terms (price, taxes, fees) are subject to contract and applicable law.

2) Eligibility & Local Laws

You are responsible for ensuring that your use of the Site complies with Thai law and any other laws that apply to you. The Site is not intended for users under the age of 20 without guardian consent, in line with Thailand’s PDPA and civil law requirements.

3) Property Listings & Financial Disclaimers

  • Listings, photos, floor plans, measurements, yields, loan illustrations, and availability are approximate and may change without notice.

  • We do not guarantee investment returns, occupancy, capital appreciation, rental yields, or financing approvals.

  • For foreign buyers: restrictions under Thai law (e.g., condominium foreign quota, land ownership, leasehold, BOI/Thailand Elite visas, etc.) may apply. Obtain independent legal, tax, and financial advice before committing to any transaction.

4) No Advice; You Remain Responsible

Content on the Site is not legal, financial, tax, or technical advice. You should obtain independent professional advice tailored to your circumstances (lawyer, tax adviser, valuer, engineer, lender, etc.).

5) User Accounts, Enquiries & Communications

  • You may submit enquiries via forms, email, LINE/WhatsApp, or phone. You agree that we may contact you using the details you provide.

  • If you create an account, you must keep your credentials confidential and remain responsible for all activity under your account. Notify us immediately of any unauthorised use.

6) Acceptable Use (What You Can’t Do)

You agree not to:

  1. Violate any applicable law or third-party rights.

  2. Copy, scrape, crawl, harvest, or index the Site or listings without written consent.

  3. Upload or transmit malware, automated scripts, spam, or any harmful code.

  4. Misrepresent your identity or affiliation, or attempt to gain unauthorised access to the Site or our systems.

  5. Use the Site to solicit users for services that compete with Mermaid Homes or to circumvent us in any transaction introduced through the Site.

We may suspend or terminate access for any breach.

7) Intellectual Property

  • The Site and all content (text, photos, graphics, logos, icons, videos, design, compilation, and software) are owned by Mermaid Homes or our licensors and are protected by IP laws.

  • We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Site for personal, non-commercial purposes.

8) Your Content & Submissions

  • If you provide content (messages, reviews, property information, photos), you represent that you have the necessary rights and that the content is accurate and lawful.

  • You grant Mermaid Homes a worldwide, royalty-free, non-exclusive license to host, store, reproduce, and display such content for Site operation and marketing (subject to our Privacy Policy/PDPA).

  • Do not submit confidential information through the Site unless we request it for a defined purpose (e.g., KYC/offer documents).

9) Privacy, Cookies & PDPA (Thailand)

  • We process personal data in accordance with Thailand’s Personal Data Protection Act B.E. 2562 (2019) (“PDPA”). 13) Liability Limitation

To the maximum extent permitted by law, Mermaid Homes and its directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of the Site.
Our aggregate liability for any claim arising out of the Site will not exceed THB 10,000 or the amount you paid (if any) for Site access in the 3 months preceding the claim, whichever is less. Some jurisdictions do not allow certain exclusions; in that case, the limitation applies to the maximum extent permitted.

14) Indemnity

You agree to indemnify, defend, and hold harmless Mermaid Homes and its officers, employees, and agents from and against all claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to:
(a) your use or misuse of the Site; (b) your content or submissions; (c) your breach of these Terms or applicable law; or (d) any actual or alleged infringement by you of third-party rights.

15) Electronic Communications & Records

You consent to receive communications from us electronically (email, messaging apps, in-Site notices) and agree that such communications satisfy legal requirements for written communications and records, to the extent permitted by law.

16) Suspension & Termination

We may suspend or terminate your access to all or part of the Site at any time, with or without notice, for conduct we believe violates these Terms or is harmful to other users, us, or third parties.

17) Governing Law & Dispute Resolution

  • These Terms are governed by the laws of Thailand, without regard to conflict-of-laws principles.

  • Any dispute arising out of or in connection with these Terms or the Site shall be subject to the exclusive jurisdiction of the courts of Thailand, with venue in Phuket Province.

  • Before filing a claim, the parties will attempt in good faith to resolve the dispute through negotiation for 30 days after written notice.

18) Changes to These Terms

We may update these Terms from time to time. Changes are effective when posted on the Site with a revised “Last updated” date. Your continued use of the Site after changes constitutes acceptance.
